The EEOC issued updated guidance for employers on December 16 in light of the FDA’s recent authorization of Pfizer’s COVID-19 vaccine for emergency use. Thorough and widespread vaccination within communities will be key in returning businesses to normal operations, including employees coming back to work. Some employers are asking whether COVID-19 vaccination can be required, or at least encouraged, among their employees. The EEOC has issued guidance that employers can lawfully require employees to be vaccinated before they return to the office, although certain limitations and exceptions apply.
